the romney campaign is suing the state of wisconsin. the campaign accusing the state of violating the voting rights of military members and other citizens living overseas. why? wisconsin missed a deadline to send out absentee ballots. griff jenkins has the latest. >> reporter: the romney campaign filed a lawsuit here in madison, against the government accountability board because 26 municipalities failed to meet the 45-day federal deadline to transmit ballots to military and overseas voters. it is a small number of ballots here, of which they are tracking, the romney campaign says every service member deserves to have his or her vote counted and one missed ballot is one too many. state representative evan nguyen is fighting it. >> they are fighting for our right to vote. they shouldn't be denied theirs because somebody back here didn't get their ballots out in time. >> reporter: kevin kennedy is the director of the government accountability board. what is going on with the military absentee ballot situation? we know, it's reported that
